Terms and Conditions

Marquee Hire Direct is a trading name of The Highfield Group, their subcontractors, agents and or representatives and are referred to in these Standard Terms and Conditions as the ‘Owner’. The ‘Hirer’ is the person, representative, agent, company, firm or the like, taking the Owners Equipment on hire/sale. The ‘Equipment’ is the equipment or service supplied on hire/sale from the Owner.

General

01.1. These Terms and Conditions apply to all Contracts entered into by the Owner and shall not be excluded by any other Terms and Conditions whatsoever.

01.2. A Quotation given in writing will be binding by the Owner for a period of 14 days from the date shown on the Quotation unless shown differently on the Quotation.

01.3. A Quotation is accepted by the Owner from the Hirer either by email, in writing or verbally. On acceptance, the Owner will issue a Confirmation of Booking and invoice for the deposit payment if applicable. The deposit, if applicable, is payable upon receipt of the invoice and will normally be 10% of the value shown on the Confirmation of Booking. When the Owner receives both payment of the deposit AND a signed Confirmation of Booking, the hire is confirmed. The signed Confirmation of Booking forms the Contract between the Owner and the Hirer and is strictly subject to these Terms and Conditions.

01.4. The Owner retains title of the Equipment at all times unless an item of Equipment is clearly shown as sold. If sold, title of the equipment will not pass until the Owner has received payment in full by cleared funds from the Hirer. In the event the Hirer sells the Equipment with or without permission of the Owner, the Hirer does so as an agent of the Owner and any monies due/paid will be payable directly to the Owner. Any monies received by the Hirer for Equipment sold prior to payment in full to the Owner will be held for the benefit of the Owner.

01.5. ‘Dry hire’ is the trade hire of Equipment only. Dry hire is on the basis that collection, return, build and dismantle is the total responsibility of the Hirer using their own vehicle/s, plant and qualified staff.

01.6. ‘Wet hire’ is the trade hire of Equipment whereby the Owner also builds and dismantles the Equipment on behalf of the Hirer. The price will include for the Owner to transport, build and dismantle the Equipment. 01.7. In respect of ‘Wet Hire’, the Owner will do all possible to meet delivery/collection dates quoted on the Confirmation of Booking. The Owner will however not accept responsibility for any losses whatsoever involved in any delay caused outside control of the Owner.

01.7. Should the Owner fail to meet the obligations contained in the Confirmation of Booking, the total liability of the Owner will be limited to an amount being twice the hire charge as shown on the Confirmation of Booking.

01.8. The Owner will do all possible to supply the Equipment as shown on the Confirmation of Booking but reserves the right to vary such Equipment should the need arise and will accept no claim for compensation.

01.9. The Owner will not be responsible for colour match to other equipment either where hired from elsewhere or owned by the Hirer.

01.10. The Owner will not be responsible for compatibility to other equipment either where hired from elsewhere or owned by the Hirer.

01.11. The Owner will not be responsible for best fit of the Equipment where it is to be used with any other equipment either where hired from elsewhere or owned by the Hirer. The Hirer is totally responsible for making any necessary adjustments to suit.

01.12. The Owner will accept no responsibility or liability for non-fulfilment due to war, civil commotion, riot, adverse weather conditions, force majeure, fire, breakages, government controls, priority regulation, scarcity of equipment, labour problems, transport difficulties, acts of God or any other situation which may from time to time arise and are beyond the control of the Owner.

02. Insurance

02.1. It is the Hirer’s responsibility to ensure that the Equipment is hired from the Owner on a full and old for new reinstatement basis. Confirmation of cover in place at all times during a hire period is to be provided to the Owner by the Hirer prior to supply of Equipment. The Owner will retain insurance details provided by the Hirer for the event of further hire. The total replacement cost will be shown on the Quotation/Confirmation of Booking.

02.2. The Hirer is totally responsible for all Equipment on hire from time of delivery/collection by the Owner or collection /return by the Hirer.

02.3. The Hirer will indemnify the Owner against all claims for loss or damage however caused unless it can be proven that the Owner was negligent or in breach of any Statute or Common Law.

02.4. The Hirer will indemnify the Owner against all claims for injury to any person whosoever and howsoever caused unless it can be proven that the Owner was negligent or in breach of any Statute or Common Law.

03. Cancellation

03.1. Should the Hirer cancel a Confirmation of Booking more than seven days before the hire date, the deposit paid is non-returnable. The Hirer will be required to pay the full amount of the charge shown on the Confirmation of Booking if a cancellation is within 7 days of the commencement date of the of the hire shown as shown on the Confirmation of Booking.

04. Delivery/Collection and Late Return/Loss

04.1. When Equipment is to be collected by the Hirer, the Hirer is to be totally satisfied with the Equipment before leaving the Owners premises. The Hirer is required to sign for the equipment collected. The Owner accepts no responsibility for any shortage/damage after collection and signature of the Equipment.

04.2. Equipment is to be collected/returned on the dates shown on the Confirmation of Booking unless prior notified in writing to the Owner by the Hirer and thereafter agreed in writing by the Owner.

04.3. The Owner will charge for Equipment not collected on the arranged date unless it has been previously cancelled in writing by the Hirer to the Owner.

04.4. The hire period is as shown on the Confirmation of Booking. Any additional hire charge for Equipment not returned on the due date will be the additional daily rate shown on the Price List, charged for a period of three days. On the fourth day, the non-returned/lost equipment will be charged for by invoice at the full replacement value plus 15% cover handling and administration. This invoice is payable by the Hirer to the Owner immediately. In the period after the third day and until payment cleared funds of the replacement invoice is received, hire charges will continue to apply at the additional daily rate and are to be paid by the Hirer to the Owner immediately on receipt of an invoice.

04.5. When Equipment is delivered to site and collected by the Owner, the cost will be shown on the Confirmation of booking. The Hirer is responsible for arranging ease of access to and from the site and the offloading/loading from/to the Owners vehicle.

04.6. The Owner delivers and collects only to/from a suitable hard surface.

04.7. It is the responsibility of the Hirer to be present to accept delivery/collection of the Equipment. The Hirer is to be satisfied with the Equipment before the Owner leaves site from delivery and collection. If the Hirer is not satisfied with the Equipment, the Hirer must inform the Owner immediately and confirm it in writing within three days.

04.8. When the Owner delivers or collects the Equipment to/from the Hirer, any additional handling, standing time, obstructed access, delivery to other than as detailed, increase in charges for labour or transport costs before or during the hire period which for whatever reason is beyond the control of the Owner and not allowed for in the Confirmation of Booking will be recorded and at the discretion of the Owner, might be charged.

04.9. When the Owner collects Equipment from site, the Equipment will be visibly checked before leaving and any damage/shortage will be advised to the Hirer. At the earliest opportunity on return to the Owner’s Depot, the equipment will be fully checked and any damage/loss if found will be reported to the Hirer within 24 hours. Any damage/loss will be charged at the repair/replacement value of the item plus 15% to cover handling and administration. Payment is due upon receipt of the invoice. In the meantime, after collection and before payment of any invoice for damage/loss, hire charges will continue. Substitute Equipment will not be accepted by the Owner. The Owner will on request of the Hirer, provide written evidence of the cost to repair/replace items.

04.10 Where Equipment is received by the Owner either damaged or short, the Owner will reserve the right to decide if the loss or damage is the responsibility of the Hirer or the Owner. Where it is decided that the loss or damage is the responsibility of the Hirer, it will be charged at cost plus 15 % to cover handling and administration.

04.10. All Equipment should be returned to the Owner in good condition and not be abnormally soiled i.e. requiring additional cleaning before being re-used elsewhere. An additional cleaning charge for such soiled items will be made.

05. Payment

05.1. The Hirer is to make payment strictly in accordance with the Confirmation of Booking.

05.2. Equipment will not be provided when payment has not been made in accordance with the Confirmation of Booking.

05.3. Further Equipment will not be supplied to a Hirer if any outstanding monies are owed by the Hirer to the Owner.

05.4. The Owner reserves the right to charge interest on any amount outstanding on the due date at a rate no less than 2% per month accrued on a day to day basis.

05.5. Any discount shown is conditional on strict compliance with payment terms.

05.4. All prices are plus VAT unless shown.

06. Power Connection

06.1. The hire of electrical/heating equipment does not include connection to the power supply.

07. Fuel

07.1. Fuel (diesel or Lpgas, etc) is not included in the hire cost and is the responsibility of the Hirer unless shown.
